Virginia Possession Limits
Virginia's possession framework under the Cannabis Control Act (Title 4.1, Subtitle II) is straightforward but includes an important distinction between public and private possession:

The public possession limit increases from 1 ounce to 2.5 ounces once HB 642 takes full effect. The home possession limit remains unlimited for personal use regardless — Virginia places no cap on how much cannabis you can store in your own home, provided it is for personal consumption only.
Any person 21 years of age or older may lawfully possess on his person or in any public place not more than one ounce of marijuana.

Understanding the Public vs. Home Distinction
This is one of Virginia's most important legal distinctions:
- In public: You may carry up to 1 ounce on your person. Carrying 1 to 4 ounces triggers a $25 civil penalty. Over 4 ounces is a misdemeanor. Over 1 pound is a felony.
- At home: There is no limit. You may keep as much cannabis as you want in your private residence for personal use. This includes harvested flower from your home grow.
When transporting cannabis between private locations, keep it under 1 ounce and stored in a sealed container out of reach. Anything over 1 ounce in public — even in your car — exceeds the current legal limit.
Home Cultivation Rules
Virginia allows adults 21+ to grow cannabis at home under § 4.1-1101. The rules are specific and must be followed precisely:
Plant Limits
- 4 plants maximum per household — not per person
- Plants must be grown at your primary residence
- There is no distinction between mature and immature plants — all count toward the limit
Tagging Requirements
Every plant must be tagged with a legible label that includes:
- Your full legal name
- Your driver's license or state ID number
- A notation that the plant is for "personal use only"
The tag must be attached to the plant or its container and remain legible throughout the growing cycle. Failure to properly tag plants could result in penalties even if you are within the 4-plant limit.
Visibility and Access
- Plants must not be visible from any public way — this means not visible from streets, sidewalks, or neighboring properties without the use of binoculars or other aids
- You must take reasonable precautions to prevent access by anyone under 21 — a locked room, greenhouse, or fenced area is recommended
- Indoor growing is the simplest way to comply with both requirements
Landlord Restrictions
If you rent your home, your landlord can prohibit cannabis cultivation in the lease agreement. Even if your lease does not specifically mention cannabis, a general prohibition on illegal activity or property modifications may apply. Always check your lease before growing.
What You Cannot Do
- No concentrate manufacturing: Extracting concentrates (BHO, rosin presses excepted in some interpretations) from your home-grown plants using volatile solvents is illegal
- No growing at secondary properties: Plants must be at your primary residence only
- No selling your harvest: Home-grown cannabis cannot be sold under any circumstances
Cultivation Penalties
Exceeding the 4-plant household limit carries escalating consequences:

The jump from 4 plants (legal) to 5 plants ($250 fine) is easy to cross accidentally. If you have a growing partner in the same household, your combined total cannot exceed 4 plants. Seedlings and clones count toward the limit.
Sharing Your Harvest

If you hold a valid medical cannabis certification, you can also purchase cannabis at any of Virginia's 23 medical dispensaries. Medical patients may purchase up to 4 ounces of flower per 30 days or a 90-day supply of other products. Home cultivation rights are the same for medical and recreational users.
