Complete Penalty Reference
Virginia's cannabis penalty structure reflects its approach of decriminalization for minor offenses combined with serious consequences for distribution and large-scale violations. The following table covers all major offense categories:
| Offense | Classification | Penalty |
|---|---|---|
| Public consumption (1st offense) | Civil penalty | $25 fine |
| Public consumption (3rd+) | Class 4 misdemeanor | Up to $250 fine |
| Under-21 possession | Civil penalty | $25 fine |
| Possession 1–4 oz in public | Civil penalty | $25 fine |
| Possession over 4 oz (public) | Misdemeanor | Escalating penalties |
| Possession over 1 lb | Felony | 1–10 years / up to $250,000 |
| Distribution up to 1 oz | Class 1 misdemeanor | Up to 12 months / $2,500 |
| Distribution 1 oz – 5 lbs | Class 5 felony | 1–10 years |
| Distribution to minor | Felony | 5 years mandatory minimum |
| DUI first offense | Criminal | $250 min fine, 1-year license suspension |
| Home cultivation 5–10 plants | Civil penalty | $250 fine |
| Home cultivation 50+ plants | Felony | Significant prison time |
Every cannabis-related conviction in Virginia — from distribution to certain possession offenses — triggers a 6-month driver's license suspension, which applies on top of any other penalties.
Possession Penalties in Detail
Virginia's possession penalties scale based on the amount and whether you are in public or at home:
Public Possession
| Amount (Public) | Classification | Penalty |
|---|---|---|
| Up to 1 oz | Legal | No penalty (legal for 21+) |
| 1–4 oz | Civil penalty | $25 fine |
| Over 4 oz | Misdemeanor | Escalating penalties including potential jail time |
| Over 1 lb | Felony | 1–10 years prison, up to $250,000 fine |
Home Possession
There is no limit on home possession for personal use by adults 21+. You may keep as much cannabis as you want in your private residence. However, large quantities that suggest distribution intent rather than personal use could be investigated.
Under 21
Persons under 21 who possess cannabis are subject to a $25 civil penalty. This is not a criminal charge and does not create a criminal record. It is treated similarly to underage tobacco possession.
Distribution Penalties
Distribution penalties are among the most serious in Virginia cannabis law. "Distribution" includes any transfer of cannabis for payment, as well as sharing that exceeds the legal limits or involves minors:
| Offense | Classification | Penalty |
|---|---|---|
| Distribution up to 1 oz | Class 1 misdemeanor | Up to 12 months jail / $2,500 fine |
| Distribution 1 oz – 5 lbs | Class 5 felony | 1–10 years prison |
| Distribution to a minor | Felony | 5 years mandatory minimum |
Virginia imposes a 5-year mandatory minimum prison sentence for distributing cannabis to a person under 21. "Distribution" includes giving, sharing, or selling. This is one of the most severe cannabis penalties in the Commonwealth and there is no judicial discretion to reduce the sentence below 5 years.
Public Consumption Penalties
Public consumption penalties escalate with each offense under § 4.1-1108:
| Offense | Classification | Penalty |
|---|---|---|
| First offense | Civil penalty | $25 fine |
| Second offense | Civil penalty | $25 fine + substance abuse treatment evaluation |
| Third and subsequent | Class 4 misdemeanor | Up to $250 fine (criminal record) |
For details on where consumption is and is not permitted, see Where You Can Consume.
Home Cultivation Penalties
Growing beyond the legal 4-plant household limit triggers penalties that escalate rapidly:
| Plant Count | Classification | Penalty |
|---|---|---|
| 1–4 plants (tagged, at primary residence) | Legal | No penalty |
| 5–10 plants | Civil violation | $250 fine |
| 50+ plants | Felony | Significant prison time and fines |
DUI Penalties
Cannabis-impaired driving is prosecuted under § 18.2-266. Virginia uses an impairment-based standard with no per se THC blood limit:
| Offense | Jail | Fine | License Suspension |
|---|---|---|---|
| First DUI | Up to 12 months | $250 minimum | 1 year |
| Second DUI (5–10 yrs) | 1 month minimum | $500 minimum | 3 years |
| Third DUI (within 10 yrs) | 90 days minimum | $1,000 minimum | Potential permanent revocation |
A third DUI within 10 years is a Class 6 felony. For complete DUI details, see DUI & Driving Laws.
The 6-Month License Suspension Rule
One of Virginia's most impactful cannabis penalties is often overlooked: every cannabis conviction triggers a mandatory 6-month driver's license suspension. This applies to distribution convictions and certain possession offenses, and stacks on top of any DUI-related suspension. In a state where public transportation is limited outside urban areas, a license suspension can severely impact employment and daily life.
Federal Property
All cannabis activity remains illegal on federal property regardless of Virginia state law. Violations on federal property — including military installations, national parks, and federal buildings — are prosecuted under federal law, which classifies cannabis as a Schedule I controlled substance. Federal penalties can be significantly more severe than Virginia state penalties.
